Apple Faces Potential Antitrust Restrictions in Germany

German federal judges indicated support for antitrust regulators in their legal battle with Apple. After extensive deliberations, they acknowledged the possibility that Apple may be designated as a "company of paramount cross-market significance for competition." This designation would empower regulators to impose measures aimed at curbing Apple's market dominance.

The Federal Court of Justice (BGH) postponed a final ruling to allow for further deliberations. Apple's legal team urged the court to consult the European Court of Justice (ECJ) before making a decision. However, the presiding judge, Wolfgang Kirchhoff, stated that the judges saw no grounds for such a referral.

If Apple's designation is confirmed, it would be subject to additional controls in Germany, similar to those imposed on Google and Facebook. The increased scrutiny is intended to address concerns about Apple's market power and its potential impact on competition.
